Did you know that if you lose capacity, your spouse has no automatic right to make decisions on your behalf?

Why You Need LPAs

Without LPAs, if you lose capacity:

  • Your family cannot access your bank accounts

  • No one can pay your bills or sell your property

  • Courts must appoint a deputy (this process takes over a year)

  • Your loved ones have no legal authority to make decisions for you

  • Medical professionals may override your family's wishes

Lasting Power of Attorneys give someone you trust the legal authority to act on your behalf.

Types of LPA Explained

Property & Financial Affairs

Allows your attorney to:

  • Manage bank accounts and pay bills

  • Access and sell property

  • Manage investments and pensions

  • Claim benefits on your behalf

  • Handle tax affairs

Can be used: Immediately (if you choose) or only when you lose capacity

Health & Welfare

Allows your attorney to:

  • Make medical treatment decisions

  • Make decisions regarding life sustaining treatment

  • Decide where you live (care home, hospital, home)

  • Make decisions about daily care and routine

  • Give or refuse consent to life-sustaining treatment (if you choose)

Can only be used: When you lack capacity to make these decisions yourself

Common Questions

  • Most people do. One covers money and property, the other covers healthcare. They serve different purposes and cannot substitute for each other.

If there’s a reason you believe you only need one, we can discuss your situation.

  • Property & Financial LPA: Immediately (if you choose) or when you lose capacity.
Health & Welfare LPA: Only when you lack capacity to make decisions.

We will discuss all of your options and make sure you’re comfortable with your decision.

  • Your family must apply to the Court of Protection to become your deputy. This costs £4,000+ in court fees, takes a year to process, and requires annual reporting to the court.

  • Yes. You can revoke LPAs at any time while you have mental capacity. We can help you create a new version if your circumstances change.

  • Someone you trust completely. Usually a partner, adult child, or close family member. We recommend appointing backup attorneys in case your first choice cannot act.

  • Yes, you can complete LPAs yourself using the government's online service. However, much like cutting your own hair, just because you can doesn't mean you should.

The LPA forms have multiple points where the Office of the Public Guardian advises you to seek professional help. The wording of preferences, instructions, and restrictions is extremely nuanced - small mistakes can invalidate your entire LPA.

The risk: You won't discover errors until you've lost capacity and your family tries to use the LPA. At that point, it's too late to fix, and your loved ones face the exact court process you were trying to avoid (£4,000+ and over a year).

  • The Office of the Public Guardian registers and oversees LPAs. Registration costs £164 (included in our price) and makes your LPAs legally valid. Unlike your Will, you have to register your LPAs for them to be valid.
